Cove Communications makes no warranty of any kind, expressed or implied with respect to our products and services. The Customer agrees to hold Cove Communications, its Employees and Vendors harmless of any damage or liability (direct or indirect) resulting from the use of our products and services. Cove Communications will make every reasonable effort to ensure reliability and availability of our products and services. However; Cove Communications disclaims any warranty that our services shall be "error free" or without interruption. Cove Communications will make every reasonable effort to protect the Customer's electronic mail and documents from loss or access by unauthorized parties. However; Cove Communications makes no guarantee of the privacy of electronic mail or documents stored on equipment owned by Cove Communications or transmitted through our network. Cove Communications strongly recommends that the Customer encrypt their sensitive documents or electronic mail before transmission through our network or the Internet. Cove Communications will not be held liable for the loss of files stored on or transmitted via equipment owned by Cove Communications. Cove Communications strongly recommends the customer maintain backup copies of their files. The Customer assumes responsibility for the security of their equipment while using the services of Cove Communications. The Customer is aware that linking their computer to the Internet through Cove Communications makes their equipment vulnerable to hackers, viruses and other attacks including "denial of service." The Customer agrees not to use Cove Communications' products or services in violation of any local, state, or federal law. These violations include, but are not limited to, credit card fraud, hacking (i.e., attempting to gain unlawful access to private computer systems and networks), slander, and the transmission of threats or harassment. The Customer agrees not to use Cove Communications' products or services for any of the following activities:
Cove Communications reserves the right to terminate the account of any customer violating any of the above conditions without refund and without prior notice. The customer will be liable for any damages or expenses incurred by Cove Communications as a direct result of the customer violating these terms and conditions. Cove Communications will not be responsible for long distance charges resulting from a customer dialing into Cove Communications. It is the Customer's responsibility to insure the number being dialed is local. The Customer assumes all responsibility for the content received from the Internet when using Cove Communications' services and accounts. The Customer must follow all Trademark, Copyright and Patent laws pertaining to the content received over the Internet or from Cove Communications' Web Pages, Manuals, Documents, distribution media or White Papers. The Customer agrees to hold Cove Communications harmless for any inappropriate, questionable or illegal materials obtained over the Internet or stored on equipment owned and operated by Cove Communications. Parents assume all liability and responsibility for the content viewed by their children through the Internet and the services of Cove Communications. While Cove Communications does not in any way endorse censorship, the parent might consider monitoring their children's activity. Parents might also consider the use of software to restrict the use of the Internet. These "restrictive" software packages are available through various retail outlets and software archives on the Internet. Cove Communications assumes no responsibility over the use or effectiveness of such software. Cove Communications reserves the right to make changes to its rates from time to time. Credit Card billing is done automatically on the first of the billing month. Payments by cash or check are due by the end of the billing month (i.e., the last day of the month in which the Customer's Invoice/Statement is received). Payments received after the billing month will be considered delinquent and may be subject to a late fee. Checks returned to Cove Communications unpaid are subject to a $25 fee and immediately place the account in default. Requests for changes to an account (e.g., change of subscription rate, termination of account, etc.) will be reflected in the following billing month. New accounts opened within a billing month will initially be charged for a full month's rate and then charged the appropriate pro-rated amount on the following billing month. A customer wishing to cancel their account within the first billing month may be refunded the appropriate pro-rated amount, however the "sign-up" fee (i.e., installation fee) is non-refundable. Accounts in default are subject to termination of service and an interest charge of 5% may be applied to the outstanding balance. Accounts terminated for nonpayment will only be re-instated after the Customer's total outstanding balance, current month's billing and a $20 reconnection fee is received by Cove Communications. A terminated account does not relieve a Customer of their obligation to pay any outstanding balance. The Customer agrees to pay Cove Communications its reasonable expenses, including attorney and collection agency fees, incurred while enforcing its right to collect any unpaid balances. Cove Communications reserves the right to cancel a Customer's account for any reason, at any time. The Customer remains responsible for all fees and charges incurred prior to termination or cancellation. Cove Communications reserves the right to make modifications to these terms and conditions at any time without further notice. Use of Cove Communications' services and products constitutes acceptance of these terms and conditions. Violations of these terms and conditions by Cove Communications' Customers should be reported to abuse@cove.com. When reporting violations, please include as much information as possible.
